“They never actually followed the standards they’re charged with keeping,” Yoo told me—which is odd, because holding lawyers to professional standards is “all this office does.”

UC Berkeley School of Law Dean Christopher Edley Jr., who … has resisted the calls for ideological cleansing of the law-school faculty in favor of academic freedom.…said in a statement last week, “I hope these new developments will end the arguments about faculty sanctions, but we should and will continue to argue about what is right or wrong, legal or illegal in combating terrorism. That’s why we are here.”

Law School Dean Christopher Edley says he supports debate and discussion…. “While many students and faculty are critical of the Bush administration policies and even of some of John’s actions, they think that academic freedom means that his right to be here and to teach has to be protected, until or unless there’s some sort of a conviction.”

Vital principles of academic freedom require that all of us affirm and respect his right to teach and the right of our students to take courses from him without interference, including disruption or intimidation. I have specifically asked my staff and the university police to make reasonable efforts to prevent such disruption or intimidation and, if unsuccessful, to arrest trespassers.

Christopher Edley Jr., dean of the University of California-Berkeley’s School of Law, said the President’s transition team—of which he was a member—had a difficult time whittling down its priorities. “We tried to make a list of just two or three things and couldn’t do it,” he said.

“You have to appreciate that overwhelming advice, non-stop for the last year and a half, has been ‘Forget about education; do that later.’ And he keeps putting it up there; he keeps pushing it to the front burner so I think there’s no issue there about the fact that the President understands it, he understands the importance of it with respect to the economy. The question is whether or not he’s going to pick the right strategy to advance the program.”

If this really is a national priority, both with respect to opportunity and with respect to competitiveness, you have to ask yourself whether a 19th century model for financing and governing K-12 is going to work in this century, and I profoundly believe the answer is no.

Christopher Edley, Chris Kutz, Jesse Choper Discuss Academic Freedom and Prof Yoo

PBS, The NewsHour With Jim Lehrer, October 20, 2009 by Spencer Michels

Christopher Edley, dean, U.C. Berkeley Boalt Hall School of Law: While many students and faculty are critical of the Bush administration policies and even of some of John’s actions, they think that academic freedom means that his right to be here and to teach has to be protected, until or unless there’s some sort of a conviction.

Christopher Kutz, president, U.C. Berkeley Academic Senate: You need something more than simply incompetence to revoke a professor’s tenure, especially somebody who’s been hired, promoted, published in the top journals. John is one of the most prolific scholars on the Boalt faculty.

Jesse Choper, law professor: He gave them an approach that was wholly consistent with virtually everything he did as a scholar beforehand.
